Terms of Service

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Site or place an order. By using the Site, you represent that you meet these requirements. Dealer accounts are subject to additional eligibility and approval at our discretion.

2. Account Registration

Some features of the Site (such as dealer accounts) require you to create an account. You agree to provide accurate and complete information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

3. Products, Pricing, and Availability

We work hard to keep product descriptions, images, specifications, and pricing accurate, but errors may occur. We reserve the right to correct errors, change prices, and modify or discontinue products at any time without notice. If we discover a pricing or product description error after you place an order, we will contact you to confirm or cancel the order before charging your payment method.

Stock items (typically White and Tan) generally ship within 3–5 business days. Special order colors (such as Khaki and Gray) require additional lead time. All availability is subject to change.

4. Orders and Payment

By placing an order, you make an offer to purchase the products at the listed price plus applicable shipping, taxes, and fees. We may accept or decline any order at our discretion. An order is not confirmed until we send a written order confirmation.

We accept major credit cards (Visa, Mastercard, American Express, Discover) and ACH bank transfers. Payment must be received before products are shipped unless other terms have been agreed to in writing (for example, approved dealer terms). You authorize us to charge your selected payment method for the full amount of your order, including any taxes and shipping charges.

5. Shipping and Delivery

Shipping options, costs, and lead times vary by order size, product, and destination. Large orders may ship by freight carrier on pallets. Full details are available on our Shipping & Returns page.

Inspection at delivery: you are responsible for inspecting all shipments upon arrival and noting any damage or shortage on the carrier’s Bill of Lading (BOL) before signing. Failure to do so may limit our ability to file a freight claim on your behalf.

6. Returns and Refunds

Due to the custom and bulk nature of vinyl fencing, all fence product sales are final. We do not accept returns on fence panels, posts, gates, or any cut or made-to-order materials. Unused, factory-sealed accessories may be eligible for return with prior authorization. Damaged or defective items must be reported within 5 business days of delivery. 7. Warranty

Our vinyl fence products are backed by a Transferable Limited Lifetime Warranty through our manufacturing partner. Warranty terms, coverage, and limitations are described on our Warranty page. Except as expressly stated in the written warranty, we make no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

8. Use of the Site

You agree to use the Site only for lawful purposes. You will not:

• Violate any applicable law or regulation;
• Use the Site to send spam, malware, or harmful content;
• Attempt to access areas of the Site you are not authorized to access;
• Interfere with the operation of the Site or any other user’s use of it;
• Copy, scrape, or republish content from the Site without our written permission;
• Use the Site to compete with us or build a competing product or service.

9. Intellectual Property

All content on the Site — including text, graphics, logos, images, product photographs, technical drawings, and software — is the property of Apex Vinyl Fence or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages from the Site for your personal, non-commercial use, but you may not otherwise reproduce, distribute, or create derivative works without our prior written permission.

“Apex Vinyl Fence” and our logos are trademarks of Apex Vinyl Fence. Other product and company names mentioned on the Site may be trademarks of their respective owners.

10. User-Submitted Content

If you submit reviews, photos, comments, or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with our business. You represent that you own or have the right to share any content you submit, and that the content does not violate any third party’s rights.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Apex Vinyl Fence and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party right.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site or products will be brought exclusively in the state or federal courts located in Bonneville County or Jefferson County, Idaho, and you consent to the jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be communicated through the Site or by email. Your continued use of the Site after changes take effect means you accept the updated Terms.

16. Termination

We may suspend or terminate your access to the Site or any account at any time, for any reason, including violation of these Terms. Provisions of these Terms that by their nature should survive termination will survive, including Sections 9 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 14 (Governing Law).

17. Miscellaneous

These Terms, together with any policies linked from the Site (including our Privacy Policy, Shipping & Returns Policy, and Warranty), are the entire agreement between you and Apex Vinyl Fence regarding the Site and products. If any provision is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
